  • The term “Megabox Fitness Limited” or “us” or “we” refers to the owner of the website whose registered office is The Neighbourhood, 1st Floor, 44 Warwick Street, Leamington Spa CV32 5JS. The term “you” refers to the user or viewer of our website.

  • The use of this website is subject to the following terms of use:
    - The content of the pages of this website is for your general information and use only. It is subject to change without notice.
    - Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. 1 - General

  • Megabox Fitness reserves the right to close the facility during trading hours for any reason, without notice or compensation.

  • Megabox Fitness reserves the right to refuse entry to any persons without explanation.

  • Due to the nature of the activities performed at Megabox Fitness, participants are advised that this can be a dangerous environment and participation in any activity is done so at your own risk.

  • You will be given a digital membership card when you join which is part of the joining fee you pay. 

  • Members must always keep their personal details up to date. Any changes should be made via your account in our booking system or directly with a member of staff. 

  • We ask you to familiarise yourself with the contents of our signs, notices on display and the location of the emergency exits.

  • Failure to adhere to the rules outlined within the terms and conditions may result in the termination of your membership.


2 - Rules of Membership

Use of the facilities:

  • Our opening hours can be found on our website. These times are subject to variation for operational purposes.  

  • To have complete access to the facility and the booking system (session packages etc) you will need to pay the joining fee. Once the joining fee has been paid your access will be granted and you will be required to book an induction with a coach before you are allowed to train by yourself. 

  • Induction sessions are mandatory for every person wanting to train at MegaBox, if you do not complete an induction, you will not be allowed to train by yourself until this has been fulfilled.

  • Taster sessions are available to purchase, if you decide you would then like to join and gain complete access, then you can pay the remaining difference of the joining fee. 

  • Having access to the facility is dependent on you maintaining payments of your session packages. If you haven’t purchased any session packages you will not be allowed to use the facility until this has been rectified.

  • You will be provided with your personal non-transferable membership number and digital membership card that you will be required to scan upon entry. If your membership number/ card is used by anyone else with your knowledge or consent, then we reserve the right in our sole discretion to suspend and/or cancel your membership.

  • Every person training at MegaBox must have their own boxing gloves, this is for hygiene purposes. When you come to your induction, we will lend you a pair for the induction session which you will return to us at the end before you leave the facility. After your induction, if you decide to join and come regularly to train you will need to bring your own gloves, if you don’t already own gloves you can purchase them from us or from a third party. We would advise you to have fingerless MMA gloves for ease during the session and to avoid removing your gloves multiple times during the session. 

  • If you are a Student, we will ask for proof of Student ID so you can access the student discount, if you cannot provide us with a Student ID which is valid and still in date we have the right to charge you the remaining balance on your account if products have already been purchased through the website. 

  • You must use the main entrance to Megabox when you enter or leave (unless there is a fire or other emergency).

  • You must inform us if you have sustained a personal injury or have developed a medical condition that may have consequences for your training since signing your PAR-Q form which you will be required to fill in when joining. 

  • Equipment must be treated with respect. Please refrain from dropping weights and they should be replaced to where you found them after use.

  • Equipment must be wiped down after use, left clean and dry and replaced in the correct area.

  • You may not use the gym or participate when under the influence of alcohol, drugs or any medication that may affect your safety.

  • Only MegaBox coaches are permitted to train members at MegaBox.

  • There may be limits on the number of people who can use the facility at any one time, and we may restrict access in order to observe those limits. 


Payment and Booking

  • If you are paying on the day, please note we will have no facilities on site to accept cash, we are only accepting payment by bank card.

  • Bookings can be made via the website or directly at the facility. All payments will be taken in advance. Bookings are only accepted from members whose membership fees are up to date.

  • Bookings can be made a week in advance.

  • You must arrive and be ready to start at least 5 minutes before your booked time slot. If you are late you may have to fit in after others have started their booked slot. There will be a maximum of 4 other people within your 15-minute timeslot and you will all start at 15 minute increments so please bear this in mind when you book your slot that you may not necessarily be starting at the said time, it could be at any time within the 15 minute timeslot. 

  • If you are late and cannot fit in after and decide to leave, again this will count as a session credit used.

  • Your arrival into the facility must be registered at the reception desk by scanning your digital membership card. 

  • Cancellation of a booking must be made no later than 3 hours before the booking is due to start. Any cancellations received within 3 hours of the start time will mean you will be charged, and the appropriate credit will be debited from your membership account. 

  • If you do not attend a booking, you will be charged, and your account will be credited. 

  • If you have an injury or illness that may affect your ability to participate, please consult one of our coaches when you arrive to chat with them before you start training. 

  • We reserve the right to restrict a member’s ability to pre-book sessions if the member persistently fails to attend booked sessions.

  • If you book a time slot, our booking terms and conditions apply. These terms and conditions are listed above. 

  • We ask that if you have booked a class and cannot attend that you please cancel your booking to open up a space for other members/ participants.
    We operate a 3 strike no show policy; this means that if after 3 times if you fail to cancel your booking and don’t show up to the class we reserve the right to revoke your booking rights for a set amount of time defined by MegaBox.

Refunds and Cancellations

  • We are unable to offer a refund or change the date and/or time on any booking unless we receive a minimum of 2 hours’ notice.

  • If we have to close a section or entirety the premises, due to Government guidelines regarding Covid 19, all bookings already paid for will be moved to a future date once re-open. Under these circumstances, refunds will not be issued, but we will honour bookings that have already been paid for and move them to a later date upon customer request.

Customers Personal Belongings

  • Customers are responsible for the care and safe keeping of all their personal possessions. MegaBox Fitness Ltd will not be held liable for any loss, theft or damage of customers possessions.  Lockers are provided for the safe keeping of personal belongings.

  • Membership fees do not cover the cost of lockers.
    Any property stored in lockers is stored at your own risk, the lockers are not designed to protect valuables and you must use them as though they are not safe. We regret that we cannot accept liability for any loss or damage that may occur to items stored in lockers.

  • You must not leave valuables or personal belongings in the changing rooms whilst you are training, please use the lockers provided. If there are locker keys, they must not be taken from the facility. 

  • If you find anyone else’s property on our premises, you must hand it into reception immediately.

Behaviour

  • You must behave appropriately, respectfully and politely and with consideration for other users and our staff at all times when you are on our premises. You must not spoil any other user’s use or enjoyment of the Megabox Fitness experience.

  • You must wear clothing and footwear which is suited to your activities. You must not wear clothing, which is too revealing, causes offence, or is dirty or unhygienic.

  • You must change your clothing or footwear if a member of our staff thinks that it is not suitable or appropriate and asks you to change it. If you are in doubt about whether any clothing or footwear is suitable or appropriate you must consult with a member of our staff.

  • You must not wear any jewellery which may injure anyone.

  • You must not act in any violent, abusive, intimidating or threatening way. You must not racially abuse or sexually harass anyone.

  • You must not act in any way which is dangerous or causes distress to anyone.

  • You must not use bad or offensive language, swear, verbally abuse or insult any of our staff or other users.

  • You must not bring use or be under the influence any illegal drug/s or alcohol whilst on our premises.

  • You must not bring any animal (except a registered or accredited guide dog if you have a sight or hearing disability or a trained medical alert dog) onto our premises.

  • You must not consume any food in the gym.

  • Except in an emergency, you must not take phone calls in the gym.

  • When using a phone, you must be considerate to other members and their guests. You must not prevent or delay others using any equipment of facility by spending time on the phone or texting or using your phone in any other way and you must not disturb others by taking or making long or loud calls.

  • You must not take photographs or make a video or voice recording of any other person at any time while on our premises.

  • You will be liable for any damage caused to our equipment or facilities which you cause deliberately, negligently or in breach of any of these Rules.

3 - Health & Safety

General Rules

  • You must not enter our premises if you have an infectious illness or condition.

  • You must consult your doctor before using any of the facilities at Megabox Fitness and act on medical advice if you are undergoing any medical procedure or if you have diabetes, high or low blood pressure, heart disease, any condition which causes breathing difficulties, a skin disorder, any other medical condition which might affect your ability to use our facilities safely, or if you are pregnant.

  • You must inform a member of our staff if you have a medical condition which may put you at risk.

  • If you feel unwell whilst exercising or using any of the facilities at the Megabox you must immediately stop exercising or using that facility and notify a member of staff immediately.

  • If there is a fire or if you hear an alarm (unless you have been informed by our staff that it is a test), you must make your way out of the Gym as quickly as possible, without stopping to collect any belongings, through the nearest exit, and go to the advertised assembly point. 

  • You must not block or make it difficult to use any fire or emergency exit.

  • If you have, or if you witness an accident or a near miss, or if you sustain an injury while on our premises, you must immediately report it and the circumstances in which it happened to our senior manager on duty at the time.

  • You must not smoke or use e-cigarettes anywhere inside our building. 

COVID-19

  • You must allow us to take your temperature if we ask whenever you visit our premises and you must immediately leave our premises if you have a high temperature.

  • You must use the hand sanitiser and any protective equipment we provide, comply with our social distancing measures and instructions and any other measures we take to help protect against infection or transmission.
